ZeroDay End User License Agreement
1. This agreement
This End User License Agreement (“EULA”) is between you and plasmatic dev (“plasmatic”, “we”, “us”). It governs your use of ZeroDay, our antivirus software, including its installer, definitions, updates, documentation and any cloud features it uses (together, “ZeroDay”).
By installing or using ZeroDay, you agree to this EULA. If you install ZeroDay on behalf of an organisation, you agree on its behalf and confirm that you have authority to do so. Our Terms of Service and Acceptable Use Policy also apply; if they conflict with this EULA on anything about ZeroDay, this EULA wins. Our Privacy Policy explains how we handle data.
If you do not agree, do not install or use ZeroDay.
2. Your licence
We grant you a free, non-exclusive, non-transferable, revocable licence to install and use ZeroDay, in object-code form, on any number of devices that you own or control, for personal or commercial purposes. That includes installing it on your organisation’s devices that you administer.
ZeroDay is currently available for Windows 10 and Windows 11. We plan versions for macOS and Linux; this EULA will apply to them unless they come with their own terms. ZeroDay is free to use, shows no ads and does not require an account.
3. Restrictions
You may not:
- sell, rent, lease, lend or sublicense ZeroDay, or charge anyone for it;
- modify ZeroDay or create derivative works based on it;
- reverse engineer, decompile or disassemble ZeroDay, except to the extent the law where you live expressly allows this despite a contractual restriction (for example, to achieve interoperability), or for good-faith security research under our disclosure policy;
- remove or alter any copyright, trademark or other notices in ZeroDay;
- bypass or tamper with ZeroDay’s protection or update mechanisms, except when testing your own devices under the disclosure policy (turning features off through ZeroDay’s own settings is fine);
- use ZeroDay, its definitions or its verdicts to develop, test or improve malware, or to help any software evade detection (see the Acceptable Use Policy);
- publish ZeroDay for download anywhere other than our website. Please link to our download page instead, so people always get an authentic, current build. You may copy the unmodified installer to devices you own or control.
4. Automatic updates
Protection depends on staying current, so ZeroDay updates itself automatically. It regularly checks for and installs new detection definitions and new versions of the app. To do this, it sends an anonymous install ID and its version number to our servers. By installing ZeroDay, you agree to receive these updates.
Updates may add, change or remove features, and this EULA applies to them unless an update comes with different terms. If you block updates, ZeroDay may stop protecting you against new threats. We may end support for older versions of ZeroDay, and for operating system versions that their vendor no longer supports.
5. Cloud lookups and data
ZeroDay uses our cloud reputation service to check files quickly and catch new threats. Here is exactly what it sends:
- By default: the SHA-256 hash of files being checked, plus minimal file metadata (size, type and digital signer), and, for update delivery, an anonymous install ID and the app version. ZeroDay does not upload your files and does not send us your browsing history.
- Only if you turn on “Sample sharing”: full copies of suspicious files (“samples”), so we can analyse new threats and improve detection for everyone. Samples could contain personal information, for example if a document is flagged. Sharing is off by default and you can turn it off at any time.
- Only if you turn them on: crash reports and usage diagnostics, which help us fix bugs and improve the app.
We do not show ads, sell data or require an account. Some protection relies on cloud lookups, so it may be less effective while your device is offline. The Privacy Policy explains how we use and keep this data and your rights over it.
6. Quarantine, removal and your files
Depending on your settings and what it finds, ZeroDay may:
- block a file from running or opening;
- move a file to quarantine, where it is isolated so it cannot run. Quarantined items can generally be restored from ZeroDay’s quarantine view if you are sure they are safe;
- remove or repair files, settings or other items that it identifies as part of a threat;
- block websites or downloads through web and download protection;
- stop apps from changing files in folders protected by the ransomware shield until you allow them, which can affect legitimate software such as backup or editing tools.
Please keep regular backups of anything important, ideally on a separate or offline device, and review ZeroDay’s prompts before you act on them. You are responsible for decisions to restore, allow or exclude files and apps. If you think ZeroDay has made a mistake, please report it so we can fix the detection for everyone.
7. Your responsibilities
- Install ZeroDay only on devices you own or control, or that you are authorised to manage.
- If you deploy ZeroDay on devices other people use, such as employees’ computers, you are responsible for any notices or consents the law requires, including about the data ZeroDay sends and about Sample sharing if you turn it on.
- Keep your operating system and other software up to date, and do not rely on ZeroDay as your only safeguard.
- Follow the law and our Acceptable Use Policy when using ZeroDay.
8. Ownership and open-source components
ZeroDay is licensed, not sold. We and our licensors own all rights in ZeroDay, including its code, detection engine, definitions and the ZeroDay name and logo, and we reserve all rights not expressly granted in this EULA.
ZeroDay may include open-source components. Each is licensed under its own licence, and the notices for them are included with ZeroDay. Nothing in this EULA limits the rights those licences give you over those components.
9. No warranty
ZeroDay is designed to reduce risk, but no security product catches every threat. We do not promise that ZeroDay will detect or prevent all malware, ransomware, phishing or other attacks, that it will never flag a safe file, that it will be compatible with all other software, or that it will run without interruption or errors.
To the fullest extent the law allows, ZeroDay is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement.
If you are a consumer, you may have rights under consumer law that cannot be excluded, such as the right in the EU and UK for digital content to be as described, of satisfactory quality and fit for purpose. Nothing in this EULA affects those rights.
10. Limitation of liability
Nothing in this EULA limits or excludes liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or for anything else that cannot be limited or excluded by law.
Subject to that, and to the fullest extent the law allows:
- we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, business or goodwill, arising from your use of, or inability to use, ZeroDay, including losses caused by a threat ZeroDay did not detect or by quarantining or removing a file;
- our total liability arising out of or in connection with ZeroDay is limited to the greater of the amount you paid us for ZeroDay (normally nothing) and USD 50.
If you are a consumer in the EU or UK, we are responsible for foreseeable loss or damage caused by our breach of this EULA or our failure to use reasonable care and skill. If defective digital content we supplied damages your device or other digital content, and this happened because we did not use reasonable care and skill, we will either repair the damage or compensate you. The cap above does not reduce these rights.
11. Termination
This EULA applies until it ends. You can end it at any time by uninstalling ZeroDay. We may end your licence if you breach this EULA. We may also discontinue ZeroDay or a particular version or platform; where practical, we will give reasonable notice on our website.
When the EULA ends, you must stop using and uninstall ZeroDay. Sections 3, 8, 9, 10, 12 and 13 continue to apply.
12. Export controls and sanctions
ZeroDay may be subject to export control and sanctions laws, including those of the United States, the European Union and the United Kingdom. You may not download, use, export or re-export ZeroDay in breach of those laws, including in or to a comprehensively sanctioned country or region, by or for a person on a government restricted-party list, or for a prohibited end use.
13. General
- Governing law and disputes. Section 17 of our Terms of Service applies: this EULA is governed by the laws of the United Kingdom, and consumers keep the protection of the mandatory laws of the country where they live.
- Changes. We may update this EULA, for example when we release a new version of ZeroDay. We will post the updated EULA here with a new date and, for material changes, tell you through the app or on our website before they take effect. If you keep using ZeroDay after that, the updated EULA applies.
- Entire agreement and severability. This EULA, together with the documents it refers to, is the whole agreement about ZeroDay. If any part is unenforceable, the rest stays in effect.
